These Terms of Service ("Terms") govern your access to and use of the website operated by thedesigntime ("we," "our," or "us") at https://thedesigntime.com, including any content, features, and tools offered on the site (the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

thedesigntime is a web and app development agency. The Site is provided to help you learn about our work, request quotes, and use free tools we may offer (such as our website speed test). Paid client engagements — including websites, apps, design, and retainers — are governed by a separate written agreement (for example a proposal, statement of work, or Master Services Agreement). If there is a conflict between these Terms and a signed client agreement, the client agreement controls for that engagement.

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Site or request services. If you use the Site on behalf of a company, you represent that you have authority to bind that company to these Terms.

You may browse and use the Site for personal or business evaluation of our services. You agree not to:

• Scrape, crawl, or harvest content or data from the Site in bulk without our written permission
• Copy, redistribute, or misrepresent our content, branding, or case studies as your own
• Attempt to disrupt, overload, or gain unauthorized access to the Site or related systems
• Use the Site for unlawful, fraudulent, or harmful purposes
• Interfere with free tools (including automated abuse of our speed-test or contact forms)

Tools on the Site (including website speed checks) are provided for informational purposes. Results depend on third-party services (such as Google PageSpeed Insights), network conditions, and the URL you submit. Scores and recommendations are estimates only and do not constitute a warranty, audit certification, or guarantee of ranking, conversion, or performance. Quotes and timelines discussed before a signed agreement are estimates and may change once scope is finalized.

When you contact us or submit a form, you agree to provide accurate information and to receive replies related to your enquiry. You may opt out of non-essential marketing emails where applicable. Operational messages about an active project may still be sent as needed to deliver the work.

All content on the Site — including text, design, graphics, logos, code samples, and layout — is owned by thedesigntime or used under license, and is protected by copyright and other intellectual property laws. Client logos and case study materials appear with permission and remain the property of their respective owners.

You may not reproduce, modify, or commercially exploit Site content without our prior written consent, except for fair personal viewing or sharing a link to a public page. Deliverables created under a client agreement are owned as set out in that agreement.

The Site may link to third-party websites or rely on third-party APIs (for example analytics or PageSpeed). We do not control those services and are not responsible for their content, availability, or policies. Your use of third-party services is at your own risk and subject to their terms.

How we collect and use personal information is described in our Privacy Policy. By using the Site, you acknowledge that policy.

Fees, milestones, currencies, refunds, and late-payment terms for paid work are defined in your proposal or contract. Unless otherwise agreed in writing, deposits are non-refundable once work has started, and final deliverables may be withheld until outstanding invoices are paid.

The Site and free tools are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by law, thedesigntime and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Site or free tools. Our total liability related to the Site shall not exceed one hundred US dollars (USD $100) or the amount you paid us (if any) for Site-related access in the three months before the claim, whichever is greater. This section does not limit liability that cannot be limited under applicable law. Liability for paid client engagements is governed by the separate client agreement.

You agree to indemnify and hold harmless thedesigntime from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Site, your violation of these Terms, or your infringement of any third-party rights.

We may suspend or restrict access to the Site or free tools if we reasonably believe you have violated these Terms or if needed for security or maintenance. You may stop using the Site at any time. Provisions that by nature should survive (including intellectual property, disclaimers, liability limits, and indemnity) will survive termination.

We may update these Terms from time to time. The "Last updated" date at the top of this page will change when we do. Continued use of the Site after changes means you accept the revised Terms. For material changes, we may provide additional notice on the Site.

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of law principles. Courts in Dubai, UAE shall have exclusive jurisdiction over disputes arising from these Terms or the Site, except where mandatory consumer protections in your country require otherwise.
